General terms of sale and delivery

1 - Object and scope

These general conditions of sale (GTC) constitute the basis of commercial negotiation and are systematically sent or given to each buyer to enable him to place an order. The general conditions of sale described below detail the rights and obligations of the company BRIQUES PASSION and of its customer in the context of the sale of the goods offered on this website.

Any acceptance of the order form including the clause "I have read and accept the general conditions of sales" implies the buyer's unreserved acceptance of these general conditions of sale.

2 - Price

The prices of the goods sold are those in effect on the day the order is taken. They are denominated in euros and calculated including all tax, and also will be increased by the transport costs applicable on the day of the order.

The company BRIQUES PASSION grants itself the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

3 - Terms of payment

Orders are paid for: either by bank card; either by Paypal payment method.

Payments will be made under the following conditions: Cash payment on order.

Any unpaid order will not be shipped and may be canceled without notice to release the reserved stock.

4 - Delivery

Delivery is made: either by the direct delivery of the goods to the buyer; either by sending a notice of availability in store for the attention of the buyer; or by depositing the goods at the place indicated by the buyer on the order form.

The delivery time indicated during the registration of the order is given only as an indication and is in no way guaranteed. Consequently, any reasonable delay in the delivery of the products cannot give rise to the buyer's benefit to: the award of damages; the cancellation of the order.

The risk of transport is borne in full by the buyer. In the event of missing or damaged goods during transport, the buyer must make all the necessary reservations on the order form upon receipt of said goods. These reservations must also be confirmed in writing within five days of delivery, by registered letter sent to the company.

5 – Right of withdrawal

In accordance with the provisions of Article L 221-5 of the Consumer Code, the Buyer has the right to withdraw without giving any reason, within fourteen (14) days from the date of receipt of his order. The right of withdrawal can be exercised by contacting the Company by email at: contact@briquespassion.fr In the event of exercise of the right of withdrawal within the aforementioned period, the price of the product(s) purchased and the shipping costs will be refunded, the return costs remain the responsibility of the Customer. Returns of products must be made in their original state and complete (packaging, accessories, instructions, etc.) and be sent with Tracking. Reimbursement or replacement will be made upon receipt of the products subject to their condition. A damaged product will not be refunded, taken back or exchanged.

6 - Force majeure

The responsibility of the company BRIQUES PASSION cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure.

As such, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.

7 - Competent court

Any litigation relating to the interpretation and execution of these general conditions of sale is subject to French law. In the absence of an amicable resolution, the litigation will be brought before the Commercial Court of Lyon.
